    Fair trial rights are protected in Cambodia through both general and specific provisions set out in a number of instruments. Nevertheless, there are still many issues that need to be addressed, such as poor prison conditions, overcrowded prisons with a large number of prisoners in pre-trial detention, the presumption of innocence (which is routinely ignored), the almost non-existent right to an effective defense, juveniles who lack protection and a lack of reasoned judgements.     The right to legal aid for criminally accused persons is guaranteed by Cambodia's legal framework, however this framework is insufficient and not uniformly upheld for all offences and defendants. In reality, the state-sponsored legal aid system in Cambodia is underfunded and understaffed, resulting in the poorer members of society receiving inadequate, if any, legal representation.
