CCHR Welcomes First Draft of the ASEAN Human Rights Declaration But Urges Full Transparency and Meaningful Consultation with All Stakeholders
One of the key steps in the development of the Association of Southeast Asian Nations (“ASEAN”) – creating an ASEAN Human Rights Declaration (“AHRD”) – is one stage closer to fruition. The first draft of the AHRD has now been completed and is set to come before the ASEAN Intergovernmental Commission on Human Rights (the “AICHR”) during its 11th meeting to be held on 8 and 9 January 2012 in Siem Reap, Cambodia. While CCHR welcomes the AICHR meeting and discussion of the AHRD, it calls upon the AICHR to ensure meaningful consultation with all stakeholders during the drafting process by making the draft AHRD available to the public as soon as possible.

Efforts to Seek Suspension of Judges for Alleged Procedural Failings Obscures Flaws in the Law
Yesterday, 4 January 2012, it was reported in The Cambodia Daily (“Punish Judges in Case of Hun Sen’s Cousin, Lawyer Says”) that a lawyer, Mr Kao Ty, had filed a complaint with the Supreme Council of the Magistracy (the “SCM”) accusing three judges of bias and calling for the SCM to either transfer the judges from their workplace or suspend them from duty if misconduct on their part is found to have occurred. Mr Kao states that the judges had abused the Code of Criminal Procedure 2007 (the “Code”) and violated the laws of the Cambodian Bar Association.

As a first draft of the ASEAN Human Rights Declaration nears completion, Amnesty International called upon ASEAN institutions to make the draft public and accessible to the people of the region. An inclusive drafting process, taking into account input from civil society and any other interested individuals or groups, is crucial for the Declaration. The ASEAN Human Rights Declaration concerns every woman, man and child in the region, and it is only natural that they should be given an opportunity to have their say.
