Cambodia: Legal Coundation and Framework for the Country’s Judiciary Required
The Asian Legal Resource Centre (ALRC) wishes to bring to the attention of the Human Rights Council a major lacuna that constitutes one of the most fundamental obstacles to the enjoyment, protection and promotion of human rights in Cambodia. The lack of the required laws on the statute of judges and prosecutors as well as the lack of the legal underpinning to the organisation of the judiciary are resulting in the judiciary not functioning effectively. This crucial institution is fundamental to the actualisation of human rights and remains ineffective and lacking in independence and capacity to function.

URGENT ACTION 160 FAMILIES HAVE ONE WEEK TO DISMANTLE HOMES
Two villages in Phnom Penh, the Cambodian capital, have received an official notice that they will have to leave their homes within seven days, as a private company is redeveloping the site for tourism and commercial purposes. Around 160 families have been ordered to move from the area without adequate alternative housing or fair and just compensation being provided.

Cambodia: Another Case of a Court Being Used to Silence Human Rights Defenders
Recently, a Rattanakiri provincial court judge, Thor Saran, made a recommendation to a human rights NGO, ADHOC, to remove its prominent human rights defender named Pen Bonnar from the province where he had been working for some ten years. Judge Thor Saran said Pen Bonnar and his colleague, Chhay Ty, were under investigation for incitement and defamation, two criminal offences punishable respectively by up to five years’ imprisonment and by a fine of up to US$2,500.

OHCHR Cambodia Questions Compatibility of Recent Guilty Verdicts in Defamation and Disinformation Cases with International Standards of Freedom of Expression
In response to the guilty verdict in a defamation case yesterday, brought against opposition Parliamentarian Ms. Mu Sochua, the Cambodia Office of the High Commissioner for Human Rights emphasised the need to uphold the constitutional right to freedom of expression in Cambodia. Statement on Civil Society’s Reaction to the Phnom Penh Court’s Decision on Ms. Mu Sochua Case
The Cambodian Human Rights Action Committee (CHRAC), a coalition of 21 NGO members and the Committee for Free and Fair Elections in Cambodia (COMFREL), are deeply disappointed at the decision made by the Phnom Penh Municipal Court on August 04, 2009 ordering Ms. Mu Sochua to pay a fine and compensation in a defamation case.
